(PartiallyPolitics.com) – Jim Schultz, an ethics lawyer who had previously served under the Trump administration, predicted that former President Donald Trump was going to lose his immunity claim “swiftly” as he is facing several federal indictments.
On Dec. 22, the Supreme Court decided that they would not be looking into whether or not former President Donald Trump can be prosecuted over his attempts to overturn the 2020 presidential election. Special Counsel Jack Smith of the Justice Department had filed a request to the Supreme Court to skip over the appeals process in an effort to speed up the process which will allow the federal trial against Trump to move forward. However, the request was dismissed by the U.S. Supreme Court.
The District of Columbia Circuit Court will now be called to make a decision on this case. Schultz characterized the Supreme Court’s decisions as a “warm-up act” considering how many of the justices had come from the circuit court.
In an interview on CNN, Schultz questioned whether Jack Smith had won in this case, and argued that this is one of the cases that the Circuit Court was going to make a swift decision on. He added that he believes that the court is going to “knock down” the immunity claim “very swiftly.”
Trump’s legal team has maintained that Trump has immunity from prosecution in this case as his conduct relates to a time when he was still in office. However, the original judge overseeing this case had previously rejected this assessment, which is what led to Trump appealing to the D.C. Circuit Court.
